PROTECTION WORK DISPUTES AT BAB

The Building Appeals Board is an expert Tribunal, which operates similarly to VCAT (though under different legislation). The Board has a number of Members who include people from legal and non-legal backgrounds.

The Board can hear a number of different disputes relating to Part 7 of the Building Act (Protection of Adjoining Property), commonly including:

  • Appeals of the decision of a Relevant Building Surveyor determining protection work (section 87);
  • Disputes relating to insurance (section 93);
  • Expense claims (section 97);
  • Compensation claims (section 98).
